Terms of Service

These terms govern your use of BRAND-ME (brand-me.app), a marketplace where creators sell sponsor spots on the things their audience sees and brands bid for them. By creating an account or using the service you agree to these terms. If you do not agree, do not use the service.
1. Who we are
BRAND-ME is operated by BRAND-ME ("we", "us"). You can reach us at hello@brand-me.app or through the chat in your dashboard.
2. Accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for the accuracy of the information in your account and for keeping your login details safe.
- One person may hold a creator profile and a brand profile on the same account.
- We may suspend or close accounts that break these terms, post misleading information or abuse other users.
3. How the marketplace works
- Listings. A creator publishes a listing describing what brands can sponsor, the spots on it, their starting prices, the dates and the proof they will provide. Creators are responsible for the accuracy of their listings and for delivering what they describe.
- Bids. A brand bids on a spot at the price shown. Each new bid must be at least $100 higher than the previous one. A bid is a binding commitment and cannot be withdrawn. When a brand is outbid, the amount reserved on its card is released.
- Buy Now. Some spots have a Buy Now price. Paying it locks the spot immediately and the card is charged at once.
- Payment. When a brand bids, the amount is reserved on its card and only charged after the creator posts proof and we check it. Payments are processed by Stripe.
- Proof. Creators must post proof that each spot ran as described by the proof date shown on the listing. If proof is missing or insufficient, the brand is refunded in full.
- Logo approval. Creators may block industries and may approve or decline any logo within 24 hours of a winning bid. Declined bids are refunded.
- New creators. Until a creator has completed three listings, bids on their spots are limited to $500 per spot.
4. Fees and payouts
- Listing is free. We keep 18% of each winning bid, card fees included. The creator receives 82%.
- Brands pay the price shown. We do not add a fee to bids.
- Where we print merchandise for a listing (for example a hoodie or a mug), the printing and delivery cost is deducted from the creator's payout. The cost is shown to the creator before publishing.
- Payouts are made to the creator's connected Stripe account two days after proof is checked.
5. Content and conduct
- You keep the rights to the logos, photos, videos and text you upload. You grant us a licence to display them on the service and in communications about your listing.
- You must have the right to use everything you upload, and it must not be unlawful, misleading, defamatory or infringing.
- Brands must not use the service to advertise products that are illegal where the audience is, and must respect the industries a creator has blocked.
- Creators must clearly disclose sponsorships where the law requires it.
6. Disputes and refunds
If a brand believes the proof is insufficient, it can flag it from its dashboard. We review the proof against the listing. If we agree, the brand is refunded in full. Our decision on proof disputes is final for the purposes of the service.
7. Liability
We provide the marketplace, the bidding, the payment flow and the review of proof. We are not a party to the sponsorship agreement between a creator and a brand. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability to you in connection with the service is limited to the fees we received from you in the twelve months before the claim.
8. Termination
You can close your account at any time from your settings. Open bids and listings must be settled first. We may close or suspend accounts that break these terms.
9. Changes
We may update these terms. We will show the new date at the top of this page and, for material changes, notify you by email. Continued use after a change means you accept it.
10. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, unless the law where you live gives you stronger protection.
